STUDENTS PROTECTED UNDER SECTION 504

 

Section 504 of the Rehabilitation Act of 1973 and the Americans with Disabilities Act Amendments Act of 2008 outline protections for qualified students with disabilities who attend schools receiving federal financial assistance. The qualifications include: (1) having a physical or mental impairment that substantially limits one or more major life activities; (2) having a record of such an impairment; or (3) regarded as having such an impairment.

Section 504 requires that school districts provide a free appropriate public education (FAPE) to qualified students in their jurisdictions who have a physical or mental impairment that substantially limits one or more major life activities.  Additional information can be obtained from the U.S. Department of Education, Office for Civil Rights.

The Hudson City School District has also prepared a statement of Parent/Student Rights under Section 504.
